The conveyancing process in England is the legal process of transferring ownership of property from one person or entity to another. It typically involves the following steps:

  1. Agreement of Sale: The first step is for the buyer and seller to agree on the terms of the sale, including the purchase price and any conditions of the sale.

  2. Instruction of a Solicitor: The buyer and/or seller will usually instruct a solicitor or licensed conveyancer to handle the legal aspects of the transaction. The solicitor will undertake various searches and checks to ensure that the property is legally sound and fit for purchase.

  3. Pre-Contract Enquiries: The buyer's solicitor will submit a list of pre-contract enquiries to the seller's solicitor, which will include questions about the property, such as its boundaries, planning permissions, and any disputes.

  4. Draft Contract: The seller's solicitor will prepare a draft contract of sale, which the buyer's solicitor will review and negotiate if necessary.

  5. Exchange of Contracts: Once the buyer and seller have agreed on the terms of the sale and the legal documents have been finalised, both parties sign the contract and exchange it. At this point, the sale becomes legally binding.

  6. Completion: On the agreed date, the buyer's solicitor will transfer the funds to the seller's solicitor, and the seller will hand over the keys to the property. The transfer of ownership is then registered with the Land Registry.

  7. Post-Completion: The buyer's solicitor will ensure that all necessary post-completion tasks are completed, such as paying stamp duty and registering the new ownership of the property with the Land Registry.
